With the prominence of video remote depositions among many lawyers, the ACTL’s Task Force on Advocacy in the 21st Century has developed practical guidelines for technical and substantive success of these depositions. These include the suggestion that counsel form an agreement among themselves and, when appropriate, a court order relating to the deposition, such as the reporting service, platform and platform manager to use. Additional guidelines address recommendations regarding exhibits and technological problems that can arise before and during deposition.
